EU AI Act — Article 50.4 Compliance (fully enforceable since 2 August 2026): The 24-month transition period for the core transparency and C2PA deepfake-labeling provisions of the EU AI Act (Regulation 2024/1689) expired on 2 August 2026, making these obligations fully enforceable across the EU as of that date. TruthSource is a fully compliant operator under Article 50.4. We embed mandatory C2PA metadata manifests in every forensic certificate; provide machine-readable disclosure labels for content detected as AI-generated with ≥60% probability; maintain audit logs of all AI classifications for a minimum of 24 months; and reject any platform use that circumvents AI labeling or watermark-removal obligations. TruthSource's compliance posture is reviewed against the 2 August 2026 enforcement milestone.

US TAKE IT DOWN Act — 48-Hour Takedown Policy (effective May 19, 2026): TruthSource operates a strict 48-hour notice-and-takedown policy for non-consensual intimate deepfakes. Submit requests to: takedown@truthsource.pro. Repeated violations result in permanent account termination and referral to law enforcement.

In accordance with Article 16(m) of Directive 2011/83/EU, the right of withdrawal does not apply where performance has begun with the consumer's prior express consent and acknowledgment that they thereby lose their right of withdrawal.

By completing any purchase of a digital certification service on TruthSource, the Consumer gives prior express consent to the immediate commencement of performance and explicitly acknowledges and accepts that they irrevocably lose their statutory 14-day right of withdrawal under Directive 2011/83/EU and any equivalent national implementing legislation (including Italian D.Lgs. 206/2005 – Codice del Consumo, as amended).

This waiver is confirmed at checkout by explicit checkbox acceptance. All purchases are final once the cryptographic anchoring process commences.

TruthSource operates under the "Regime Forfettario", governed by Article 1, paragraphs 54–89, of Italian Law No. 190 of 23 December 2014.

• Domestic B2C & B2B (Italy): Invoices do not include VAT. Annotation: "Operazione in franchigia da IVA ai sensi dell'art. 1, commi 54–89, L. 190/2014."
• Cross-border EU B2B: Reverse Charge applies under Article 196 of EU VAT Directive 2006/112/EC. Annotation: "Reverse Charge — Art. 196 Directive 2006/112/EC."
• Cross-border EU B2C & Non-EU: Prices are inclusive of all charges. No VAT is separately added.

The AI Intelligence Layer (Layer 5) provides probabilistic forensic signals based on statistical models and does not constitute absolute, definitive, or infallible factual determinations regarding the authenticity, origin, or nature of any digital content.

• AI-generated probability scores are indicative only and are subject to inherent model limitations, including false positives and false negatives.
• TruthSource expressly disclaims all liability for any reputational, financial, professional, legal, or other damages arising from false positive or false negative identifications.
• No AI-generated forensic score or report shall be construed as expert testimony or legal evidence without independent expert verification.
• Users must independently verify all AI forensic results through qualified human experts before relying on them for any purpose with legal, financial, or reputational consequences.

TruthSource relies on the decentralized Polygon PoS network, which is operated by independent third-party validators entirely outside TruthSource's control.

TruthSource shall bear no liability whatsoever — and no refund or service credit obligation shall arise — for any service interruption, failure to anchor, delayed cryptographic anchoring, or incomplete verifications caused by:

• Blockchain network congestion or throughput limitations
• Validator node outages, forks, or consensus failures
• Fluctuating or spiking gas fees
• Smart contract bugs, protocol upgrades, or hard forks
• Polygon network deprecation, migration, or discontinuation
• Any cyberattack, government action, or other force majeure event affecting decentralized infrastructure

Payment disputes must be initiated exclusively through TruthSource support (legal@truthsource.pro) before contacting your bank or Stripe.

Initiating a fraudulent payment chargeback for a service that was duly rendered constitutes a material breach of these Terms and may constitute fraud under applicable law.

In such events, TruthSource reserves the right to immediately:

• Publicly invalidate all associated cryptographic certificates, marked "DISPUTED — CERTIFICATE VALIDITY SUSPENDED" on the public ledger
• Permanently and irrevocably ban the user account, email address, and associated payment methods from all TruthSource services
• Report the chargeback to Stripe's risk systems and pursue recovery of all fees and legal costs

These Terms shall be governed by and construed exclusively in accordance with the laws of Italy, subject to applicable EU regulations including the GDPR (Regulation 2016/679), the EU AI Act (Regulation 2024/1689), and the EU Consumer Rights Directive (2011/83/EU).

Any dispute arising out of or relating to these Terms shall be subject to the exclusive jurisdiction of the competent courts of Reggio Emilia, Italy.

EU consumers retain mandatory statutory rights under the laws of their country of residence. Before initiating court proceedings, parties agree to attempt good-faith resolution within 30 days via legal@truthsource.pro. EU consumers may also use the EU ODR platform: ec.europa.eu/consumers/odr.
